Một vấn đề đang được mọi người băn khoăn là “Bao nhiêu tuổi được thi bằng lái xe máy?” .Hiện nay, nhu cầu tham gia giao thông bằng xe máy ở Việt Nam là rất nhiều. Nhưng không phải ai cũng đủ điều kiện để sử dụng loại phương tiện này. Muốn điều khiển xe máy, ít nhất người điều khiển phải có bằng lái xe máy.
Bao nhiêu tuổi được thi bằng lái xe máy?
Căn cứ quy định tại Điều 60 Luật Giao thông đường bộ năm 2008 về tuổi của người lái xe máy 2 bánh được nêu rõ như sau:
- Người đủ 16 tuổi trở lên được lái xe gắn máy có dung tích xi-lanh dưới 50 cc;
- Với xe mô tô hai bánh, xe mô tô ba bánh có dung tích xi lanh từ 50 cc trở lên và các loại xe có kết cấu tương tự yêu cầu người lái xe đảm bảo đủ 18 tuổi trở lên.
Cũng theo quy định tại Điều 59 Luật Giao thông đường bộ 2008, hạng A1 – bằng lái xe thông dụng nhất hiện nay, được cấp phép cho người điều khiển xe máy có dung tích từ 50cc đến dưới 175 cc. Theo đó, để được cấp bằng lái xe máy hạng A1, người lái xe phải đủ 18 tuổi trở lên. Tuổi dự thi bằng lái xe được tính từ ngày sinh ghi trong giấy khai sinh đến ngày tham gia thi sát hạch.
Do vậy, với người chưa đủ 18 tuổi vẫn có thể đăng ký thi bằng lái xe nhưng phải đủ 18 tuổi mới được dự thi. Bên cạnh đó, với những người từ 16-18 tuổi vẫn được phép điều khiển xe máy có dung tích dưới 50 cc theo quy định mà không cần có giấy phép lái xe. Bởi với các loại xe này theo Luật giao thông đường bộ hoàn toàn không có hương dẫn về việc cấp giấy phép cho người điều khiển những phương tiện đó.

2. Bạn sinh năm 2004 đã đủ tuổi thi chưa?
Bây giờ là năm 2022, như vậy Nếu đã đến hoặc qua sinh nhật của bạn trong năm nay thì bạn đã đủ tuổi thi rồi đó. Còn nếu chưa đến thì bạn phải đợi đến đúng ngày tháng sinh của bạn trong năm nay mới đủ tuổi thi.
P/s: các bạn sinh năm 2005 chắc chắn là chưa đủ tuổi thi rồi nhé.
3. Cách tính tuổi thi bằng lái xe máy
Trong luật pháp, khái niệm “từ X tuổi” và “từ đủ X tuổi” được sử dụng để xác định độ tuổi tham gia vào quan hệ pháp luật. Do đó, bạn cần phân biết được hai khái niệm này để có thể tính đúng số tuổi được tham gia thi bằng lái xe máy.
Ví dụ, anh A sinh ngày 11/3/2005. Đến ngày 11/3/2022 anh A sẽ sinh nhật lần thứ 17, thời điểm này được tính là anh A đủ 17 tuổi. Đến ngày 12/3/2022, anh A bước sang tuổi 18 nhưng chưa đủ 18 tuổi và phải đến ngày 12/3/2023 anh A mới đủ 18 tuổi và được phép dự thi sát hạch bằng lái xe máy.
Cụ thể hơn, bạn có thể lấy ngày tháng năm hiện tại trừ đi ngày tháng năm sinh được in trong CCCD/CMND, nếu đủ 18 thì bạn đã có thể dự thi bằng lái xe. Ví dụ cụ thể như sau:
- Bạn B sinh 15/3/2003, hiện tại là 30/3/2022, thì bạn A đã được 18 tuổi 15 ngày=> Đủ điều kiện thi bằng lái xe máy.
- Bạn B sinh 15/4/2003, hiện tại là 30/3/2022, thì bạn B thiếu 15 ngày nữa mới đủ tuổi => chưa đủ điều kiện thi bằng lái xe máy.
4. Hình thức phạt đối với người điều khiển xe máy khi chưa đủ tuổi
Theo Khoản 4 Điều 21 Nghị định 100/2019/NĐ-CP, người chưa đủ tuổi tham gia điều khiển xe máy sẽ bị phạt theo những hình thức như sau:
- Phạt cảnh cáo: Với người từ đủ 14 – dưới 16 tuổi điều khiển xe mô tô, xe gắn máy (kể cả xe máy điện) và các loại xe tương tự xe mô tô
- Phạt tiền từ 400.000 VNĐ – 600.000 VNĐ: với người từ đủ 16 – dưới 18 tuổi điều khiển xe mô tô có dung tích xi lanh từ 50 cc trở lên
Do đó, nếu điều khiển xe máy khi chưa đủ tuổi sẽ bị cảnh cáo hoặc phạt tiền đến 600.000 VNĐ tuỳ vào đối tượng và độ tuổi vi phạm. Không những vậy, cảnh sát giao thông còn được phép tạm giữ phương tiện của chủ xe đến tối đa 7 ngày trước khi ra quyết định xử phạt với hành vi lái xe máy chưa đủ tuổi. Điều này đã được nêu rõ tại Khoản 1 Điều 82 Nghị định 100/2019/NĐ-CP).
Bên cạnh đó, nếu chủ phương tiện giao xe cho người chưa đủ tuổi điều khiển cũng sẽ bị phạt theo quy định của Điểm d Khoản 4 Điều 30 Nghị định 100/2019/NĐ-CP quy định như sau:
“Điều 30. Xử phạt chủ phương tiện vi phạm quy định liên quan đến giao thông đường bộ
5. Phạt tiền từ 800.000 đồng đến 2.000.000 đồng đối với cá nhân, từ 1.600.000 đồng đến 4.000.000 đồng đối với tổ chức là chủ xe mô tô, xe gắn máy và các loại xe tương tự xe mô tô thực hiện một trong các hành vi vi phạm sau đây:
đ) Giao xe hoặc để cho người không đủ điều kiện theo quy định tại khoản 1 Điều 58 của Luật Giao thông đường bộ điều khiển xe tham gia giao thông (bao gồm cả trường hợp người điều khiển phương tiện có Giấy phép lái xe nhưng đã hết hạn sử dụng hoặc đang trong thời gian bị tước quyền sử dụng)”.
